Use of Services: .
Client agrees to use all services solely for lawful and intended cleaning purposes. Any utilization of our services for illegal activities, harassment, or abuse will result in immediate termination of the agreement.
User Accounts:
Users must create and maintain accurate account information and are responsible for activity on their account.
Payments:
Users are required to provide accurate billing information and agree to payment either at the time of service or according to the agreed-upon payment terms.
Limitation of Liability:
1. Maximum Liability for Damage
A crucial clause is setting a monetary cap on the amount the company will pay out for property damage or loss resulting from the service.
• Standard Practice: Many cleaning companies limit their liability to the lesser of:
• The replacement or repair cost of the damaged item.
• A set monetary limit per occurrence (e.g., $500, $1,000, or a maximum of one to two times the cost of the cleaning service).
• The deductible on the company's insurance policy.
2. Excluded Items/Valuables
• Examples of Exclusions:
• Art, antiques, heirlooms, and non-replaceable collectibles.
• Jewelry, cash, or sensitive documents left unsecured.
• Damage to fixtures that were not properly secured (e.g., pictures hung with weak wires, loose towel racks).
• Damage resulting from a pre-existing condition (e.g., broken blinds, worn-out finishes, improperly secured items).
3. Reporting Window
The client must report any damage or dissatisfaction within a very short, specified timeframe to be eligible for a remedy.
• Standard Practice: Require reporting within 48 hours of the service completion. This allows for prompt investigation while the details are fresh.
4. Limited Scope of Work
This protects the company from being liable for issues outside the agreed-upon tasks.
• Examples: Not responsible for cleaning items/areas explicitly excluded from the service list (e.g., interior of ovens, exterior windows, or areas blocked by clutter).
5. Chemical/Product Use
If a client insists on the crew using the client's own cleaning products, Sparkle and Co. can not be held liabile for any damage caused by those client-supplied products.
